My son is in fed custody and was sentenced in July. His lawyer requested a specific place here in Texas. He is in route to Colorado of all places. Is this supposed to happen? Thanks

The inmate's designation is determined by the Bureau of Prisons in Beaumont TX. No one can influence the determination of the custody level and type facility they place an offender in. There are many possible reasons for Colorado over Texas but no one more probable than bedspace. It could also be that someone else connected to his charge is incarcerated in the prison where he wanted to be. They call that "separatee" which essentially requires the co-defendants be separated. Another is if there was some real hardcore crime that was committed, there is a place in Colorado for those (but there are also two camps which is the lowest level for non-violent short-timers). Depending on the length of his sentence, he can apply to transfer facilities in 18 months.

Lawyers who claim they can request a specific prison are just bullshitting like they did when they convinced him to take their representation. Now you find after out after-the-fact, after the money is paid that a huge percentage of lawyers are liars and unless you have a bulldog fighting for you in open court, most are worthless. Even the sentencing judge can do no more than recommend a facility that is closest to his home address - his lawyer should have said just that.

If you are going to plead out anyway, you aren't getting ANY value hiring an attorney. Ask us, we've already been through it and can smell their BS a mile away.
