In Illinois, yes, it is possible. Introducing contraband into a correctional facility is taken extremely seriously and the charge level depends on what the contraband is and how it was brought in.

Cigarettes are contraband in most Illinois correctional facilities because smoking has been banned in state prisons for years. Possessing tobacco inside is an infraction, but the more serious criminal exposure comes when someone on the outside attempts to bring or send cigarettes into a facility. Smuggling contraband into a prison in Illinois can be charged as a felony, and depending on the circumstances and what else is involved, charges can escalate significantly.

A Class X felony is Illinois's most serious felony classification outside of first-degree murder. It carries a mandatory minimum of six years and a maximum of 30 years with no possibility of probation. Getting to a Class X on cigarettes alone would typically require aggravating factors, such as the contraband being part of a larger smuggling operation, being brought in by a corrections officer or staff member, or being combined with other more serious contraband like drugs or weapons.

For an inmate simply caught with cigarettes inside, the consequence is more likely a disciplinary infraction resulting in loss of privileges, time in the SHU, or a misdemeanor charge rather than a Class X. But for anyone on the outside thinking about slipping tobacco into a facility, the criminal exposure is real and not worth the risk.
