Bond and home detention are two distinct mechanisms that both allow someone to avoid or leave jail, but they work differently and are granted under different circumstances.

Bond is determined at the initial appearance before a judge or magistrate, typically within 24 to 72 hours of arrest. The judge weighs factors including the severity of the charge, criminal history, ties to the community, flight risk, and public safety before setting an amount. Once set, the full amount can be posted in cash directly with the court, which is returned at the conclusion of the case. Alternatively, a bail bondsman can post the bond for a non-refundable fee of typically 10% of the total amount. If bond is denied, the individual remains in custody until their case resolves or a bond reduction hearing is requested.

Home detention is a different category entirely. It is not something that is simply applied for. A judge orders it either as a condition of pretrial release, meaning instead of posting bond the person is released under electronic monitoring, or as part of a sentence, meaning the judge determines that a period of home confinement is an appropriate alternative to or conclusion of incarceration. An ankle monitor or similar device is used to verify the person remains at an approved address during specified hours.

For someone already incarcerated and hoping to transition to home detention, the pathway typically runs through the defense attorney, who can petition the court for a modification of the sentence or release conditions. For federal inmates, the Bureau of Prisons also has authority to place eligible inmates on home confinement in the final portion of their sentence as part of the reentry process.
