How long to see a judge after probation violation

My boyfriend got locked up last night for having a warrant violating his probation by not attending to his probation visit and court. He also had a possession of controlled substance. What I wanted to know how long will it take for him to go to court?

It usually happens much sooner than a few months, at least for the first court appearance.

After an arrest for a probation violation and a new charge, the process typically looks like this:

Initial appearance (very soon)

  • He should see a judge within 24 to 72 hours (business days)
  • This is often called an arraignment or first appearance
  • The judge reviews the charges and may address bond

Probation hold factor
Because it is a probation violation:

  • He may be held without bond
  • Or have a separate hold that keeps him in custody

Next hearings
After the first appearance:

  • probation violation hearing may take a few weeks
  • The new possession charge will follow its own timeline
  • Full resolution can take weeks to a few months depending on the case

Why people think it takes longer:
The final outcome takes time, but the first court date happens quickly.

What you can do:

  • Call the jail or check the county court website for his court date
  • Contact the Clerk of Court for exact scheduling
  • Stay in touch through letters or calls while things move forward

Bottom line
He should see a judge within a couple of days for the first appearance. The overall case may take longer, but you will not be waiting months just for him to go to court the first time.
