The baseline for human smuggling convictions in the federal system starts at around five years for a first offense without aggravating factors. That is the range I saw consistently with people I did time with at FCI Miami who were caught bringing immigrants in off the coast. Five years was a common landing point for those cases when the record was relatively clean and no one was seriously injured in the process.

A bad prior record changes that calculus in a direct and documented way. Federal sentencing uses a point-based guidelines system where criminal history is one of the primary variables. Every prior conviction adds points to the criminal history category, and a higher category pushes the guidelines range upward in a meaningful way. A judge sentencing someone with significant prior history on the same smuggling charge that got a first-timer five years could easily be looking at seven, eight, or ten years depending on what is on that record and how serious those prior offenses were.

Aggravating factors in the current case also matter. Was anyone endangered or injured during the smuggling operation? Were weapons involved? Was the person in a leadership role or just a driver? All of those push the guidelines higher.

The six months already served will count as time served and get credited toward whatever the final sentence turns out to be.
