A dental abscess is not a minor complaint. Left untreated, an abscess can spread infection to the jaw, neck, and in serious cases to the heart. This is a recognized medical emergency and your son has a constitutional right to adequate medical and dental care under the Eighth Amendment prohibition against cruel and unusual punishment. Deliberate indifference to a serious medical need by prison staff is a civil rights violation.
Here is how to escalate this effectively and quickly.
Contact the case manager or counselor immediately. Call the facility, identify yourself as his parent, and explain that your son has a dental abscess that has been reported multiple times without treatment and that he cannot eat. Use the word emergency. Ask specifically what the facility's process is for emergency dental care and when the next dental visit is scheduled.
Contact the warden or facility administrator in writing. A written communication creates a record. Send a letter or email to the warden stating the dates your son submitted sick call requests, the current symptoms including inability to eat, and your concern about the infection spreading. Keep a copy. Facilities respond differently to documented written complaints than to phone calls.
Contact the chaplain. Chaplains often have direct access to administration and can sometimes accelerate a medical response when family members are not getting traction through standard channels.
File a complaint with the state oversight agency. Every state has a department of corrections or jail oversight body that accepts complaints about inadequate medical care. Filing a formal complaint creates an official record of the denial.
Consult a civil rights attorney. If treatment continues to be withheld after documented requests, an attorney can send a demand letter or file an emergency motion. Many civil rights attorneys will review these situations at no charge initially.
Do not let this wait. An abscess that has reached the point of affecting eating requires urgent treatment.
