A sexual act infraction is a formal disciplinary charge issued when an inmate engages in sexual behavior that violates facility rules. It goes on their disciplinary record and can carry real consequences including loss of good time, restricted privileges, placement in the SHU, or in some cases additional criminal charges.
The two most common situations that generate this infraction are indecent exposure in front of staff and sexual contact with another inmate.
Indecent exposure typically means masturbating in view of an officer, and the charge tends to be taken more seriously when the officer is female. It is treated as a form of sexual harassment toward staff and facilities do not let it slide. Repeat offenses can result in placement on the sex offender registry in some jurisdictions.
Being found in the shower with another inmate is the other common trigger. Even if nothing is witnessed directly, the circumstances alone are often enough for staff to write up both parties. Consensual or not, sexual activity between inmates violates prison rules across virtually every facility in the country.
Beyond the disciplinary consequences inside, a sexual act infraction can affect programming eligibility, housing assignments, and how a case manager evaluates an inmate for early release consideration. It is the kind of charge that follows someone through their entire bid and surfaces at every review.
