Will He Come Home at His Court Date After 72 Days Inside?

My fiancé has been held for 65 days with no prior offenses. He has a court date coming up at 72 days. What are the chances he gets released?

The honest answer is that the odds are not in his favor based on the situation as it stands. The fact that he has been held for 65 days without being released, despite having no prior record, tells you something important. Courts generally release low-risk first-time offenders on bail or on their own recognizance fairly quickly. The extended pretrial detention suggests the court has concerns about something, most likely that he will not appear for future hearings if released. Whatever the charge is, it is serious enough that a judge has decided the risk of him not showing up outweighs the presumption of release.

The upcoming court date, being at 72 days is most likely a hearing in the case, not a release. Unless something changes, the court will likely continue to hold him through trial. A no-prior-record status is a mitigating factor that his attorney can argue at any bail reconsideration motion, but it has apparently not been enough so far.

The most useful thing that can be done right now is making sure he has the best possible legal representation, pushing for bail. If the original bail was denied or set too high, a motion for bail reduction or reconsideration can be filed, and his attorney should be raising every argument available, including the clean record, stable ties to the community, and any other factors that address the court's flight risk concern.
