Does a VOP Blue Warrant Mean an Automatic 5 Year Sentence?

My guy had a blue warrant and was recently arrested. There is no bond for the VOP. So is that an automatic 5 years... or more?

The five year automatic sentence specifically applies to felony gun probation violations. If the original conviction involved a firearm and the probation conditions prohibited possession of a weapon, a violation of that condition carries mandatory consequences that the judge has very limited ability to deviate from. That is a specific and serious category.

For other types of probation violations, the outcome is not automatic and is entirely at the discretion of the original sentencing judge. That is the person who signed off on probation in the first place and is now looking at a situation where that trust was not honored. What that judge decides depends on several factors: the nature of the violation, the person's behavior and compliance up to this point, the original offense, and how the judge views the overall picture.

The absence of bond on a VOP is standard and does not by itself indicate what the sentence will be. Probation violations almost never come with bond because the court has already extended leniency once and is not inclined to extend it again before the hearing.

What happens at that hearing is what matters. The judge can reinstate probation with modified conditions, sentence him to a portion of the remaining suspended time, or impose the full original sentence. The range is wide and the judge has broad authority.

Having an attorney present at that hearing is not optional if the outcome matters. Someone who knows the judge's tendencies and can make a compelling case for why reinstatement or a reduced penalty is appropriate can make a meaningful difference in what that judge decides.
