Delaware is a small state -- roughly 5,000 people incarcerated -- and it operates all of its correctional facilities through one state agency, the Delaware Department of Correction (DOC). There are no separate county jails. If your loved one is incarcerated anywhere in Delaware, they are in a DOC facility.
In November 2025, Delaware DOC launched a **Friends and Family Handbook** -- 20 pages, English and Spanish, covering how to locate your loved one, visiting, phones, tablets, depositing money, commissary, medical care, the discipline and grievance process, and reentry. Delaware DOC has also completed a historic deployment of communication and programming tablets to every incarcerated person. The tablets provide communication access from housing units.

Delaware's major correctional facilities:

Most facilities are in New Castle County (northern Delaware) and within about an hour of Wilmington. Sussex Correctional in Georgetown is about 90 minutes south of Wilmington. Delaware is small enough that distance is rarely the primary barrier -- the system and its rules are.
Delaware has no for-profit prisons. All facilities are state-operated.
On tablets: Delaware DOC completed a system-wide tablet deployment to every incarcerated person. Tablets allow communication from housing units. Your Rights as a Family Member in Delaware
Visitation rights
Visitation requires being on the approved visitor list; background checks are required. Visiting schedules and contact visit availability vary by facility security classification. JTVCC, as a Level 5 facility, has more restricted visiting than lower-security facilities.

An intake and orientation process of up to two weeks occurs when a person first enters DOC custody. During this period, visiting and phone access may be limited while the person is processed, medically assessed, and oriented to DOC rules.
Video visitation is available at Delaware facilities. Verify scheduling and access through doc.delaware.gov or the facility directly.
Communication rights
Tablets are deployed to every incarcerated person and allow communication from housing units. Confirm the current phone/tablet vendor at doc.delaware.gov -- it is either GTL/ViaPath or Securus (verify). Set up a family account with the confirmed vendor before your loved one initiates contact.
All calls are recorded except legal calls to attorneys.
Notification rights
Delaware DOC notifies next of kin for serious medical emergencies and deaths. Your loved one must have designated you as next of kin and emergency contact in their DOC records. You cannot receive medical information without their written consent.
Delaware DOC is not required to notify family of transfers. Use the Delaware Offender Search at doc.delaware.gov to track current location.
Grievance rights
Internal DOC grievances must be filed by the incarcerated person. Family members cannot file internal grievances on their loved one's behalf.

In 2022, after an incarcerated person at James T. Vaughn Correctional Center organized a boycott of GTL's phone rates and was retaliated against for it -- placed in restrictive housing for distributing flyers -- the ACLU of Delaware took his case.
