Can an Inmate Be Punished for a Cellmate's Infraction?

My husband says he got restriction becouse his cellie was in someone else cell and that guys cellie went into his to wait it out. And they got caught. It makes no sense. Yet he called me this morning. I think he just wants someone else to visit this saturday. He would be in a lot of trouble right if this were the case???

Yes, it is possible, and the way it typically works is that everyone involved in or connected to an incident gets written up regardless of how peripheral their role was. If another inmate came into your husband's cell to wait out a situation happening elsewhere, and officers found them there, both the person who entered and the person whose cell it was can end up with an infraction. Guilt by association is very real inside and officers do not always have the patience or the information to sort out who did what.

That said, the severity of the infraction depends entirely on what the underlying incident was. Two inmates being in the wrong place at the wrong time during a minor dispute is very different from being connected to a fight or something more serious. The incident report is what matters and that document will spell out exactly what was alleged and what the consequence is.

One telling sign of how serious the infraction actually was is whether phone access has been pulled. If he called you this morning, the restriction is not severe. Facilities pull phone privileges quickly when an infraction is significant. Keeping phone access while being on some form of restriction usually points to something minor on the disciplinary scale.

As for the Saturday visit, if something happened that left visible marks or he is embarrassed about the circumstances, it is not uncommon for an inmate to create distance rather than explain things in person. It does not necessarily mean anything is wrong, but it is worth a direct conversation when you get him on the phone.
