Can you get early release on federal probation violation
My boyfriend is in Joe corley for not reporting to federal probation.. He called earlier and told me that in 8 months he will be reinstated. My question: is it possible that he could be released early? How do I find out an actual release date?
A federal probation violation (technically “supervised release” in the federal system) is taken seriously, and early release is not common in these cases.
When someone is picked up for not reporting:
- The court can revoke supervision
- Impose a new term of custody
- Follow it with another period of supervision
If he was told “about 8 months,” that is likely:
- The expected sentence or guideline range, or
- The time the judge indicated he may have to serve
Can he get out earlier?
Sometimes, but options are limited:
- Good time credit (federal inmates can earn up to about 15% off, if eligible)
- Halfway house or home confinement toward the end of the sentence
- Program based reductions are limited in revocation cases
Do not expect a large reduction. Most of the time will be served.
How to find the actual release date:
- Once he is designated and processed, you can check the Federal Bureau of Prisons inmate locator
- Or ask him for his projected release date after he sees his case manager
- His attorney can also confirm what the court ordered
About Joe Corley:
If he is at Joe Corley Detention Facility, that is a holding facility. His final designation and official release date may not be set yet.
Bottom line
He may get a small reduction from good time, but do not expect early release beyond that. The most accurate release date will come once he is processed into the federal system and his sentence is officially calculated.
