Child support contempt cases move on the child support agency's timeline, not a standard criminal court schedule. When someone is jailed for failure to pay child support, the agency holding the contempt order is essentially in the driver's seat on when the case proceeds, and they are under no obligation to move quickly.

The dynamic here is straightforward. The agency wants the money. As long as your husband is sitting in jail not paying, they have leverage. A court date gives him an opportunity to negotiate, make a payment arrangement, or have a judge set conditions for release. The agency may delay that hearing precisely because the pressure of incarceration is their most effective tool for producing payment.

There are a few ways this typically resolves. If your husband can pay the arrears in full or make a substantial payment that satisfies the agency, he can often secure release relatively quickly. If he cannot pay, a court hearing will eventually be scheduled where a judge can establish a payment plan and set conditions for his release. Judges in child support contempt cases generally want to see a realistic path to compliance, not indefinite incarceration of someone who has no ability to pay from inside a jail cell.

The most useful step right now is contacting a family law attorney who handles child support matters in that jurisdiction. They can communicate directly with the child support agency, determine what amount or arrangement would trigger a court date or release, and advocate for a resolution that gets your husband out and into a position where he can actually earn money and meet his obligations.
