There is no single answer to this because sentencing on fraud and theft charges depends on a combination of factors that vary significantly from case to case and state to state. What we can do is walk through what typically drives the outcome.

The number of counts matters enormously. Three counts each of identity theft, credit card fraud, theft by deception, and theft by taking means twelve separate charges. Each count carries its own potential sentence and a judge has the discretion to run those sentences concurrently, meaning at the same time, or consecutively, meaning back to back. The difference between those two outcomes can be years.

The dollar amount involved is usually the biggest driver in fraud cases. Most states tier their theft and fraud statutes by the value of what was taken. A small dollar amount might result in misdemeanor level exposure while larger amounts push into felony territory with mandatory minimums attached. Identity theft specifically carries enhanced penalties in most states because of the harm it causes beyond the immediate financial loss.

Criminal history plays a significant role as well. A first time offender with no prior record is going to be treated very differently than someone with previous convictions. Prosecutors and judges both factor in history when deciding how hard to push and what to offer.

The realistic best case scenario for a first time offender on charges like these, if the dollar amounts are not extreme, is probation with restitution, fines, and possibly a short jail sentence. More serious cases with significant financial harm and multiple victims can result in several years of prison time.
