My son's father is an inmate at Pleasant Valley State Prison. He originally got sentenced to 2yrs but with half time his out date is December 3 2014. He's not a violent offender and I heard that non violent offenders can get the 1/3 time reduction off their sentence, but in this inmates case, the 1/3 time would give him an out date later than December 3 2014. Is that even possible? And is there a chance that they might recalculate his time and give him an earlier out date for good behavior?

The new law is for federal inmates only.  It pertains to the mandatory minimum sentencing guidelines that have been changed retroactively by the US Sentencing Commission. There may be some trickle-down effect to the state level as each is looking at own mandatory minimums and the money it would save lightening the prison population. If anything does happen, it will happen first for the non-violent offenders. Recalculation is rarely if ever done.
