What to Do When Your Public Defender Won't Return Calls?

My fiace is currently awaiting his 4th court date, we have become very concerned about the potential outcome for a number of reasons one being absolutely no return contact from his attorney or any other requested help. I have tried the public deffenders office, courthouse, his attorney as well as internet research i really dont know where else to turn for help...inmate aid has been the only help ive had with staying positive and hopeful thank you.

An unresponsive attorney before a court date is a serious problem, and you are not without options even when it feels that way.

Go above the public defender directly. Call the supervising attorney or chief public defender at the office handling the case. Explain clearly that calls and messages have gone unanswered and that a court date is approaching. Supervisors take these complaints seriously because an unresponsive attorney creates both professional liability and potential constitutional issues around the right to effective counsel.

Contact the courthouse. The clerk of the court where the case is pending can confirm upcoming court dates and in some cases can note on the record that the defendant has been unable to reach their counsel. If the situation is serious enough, a judge can address attorney conduct from the bench.

File a complaint with the state bar. Every state has a bar association that handles complaints about attorney conduct. An attorney who consistently fails to communicate with a client before court appearances is subject to disciplinary review. Filing a formal complaint creates a record and sometimes produces a rapid change in responsiveness.

Request a new attorney. Your fiance can ask the judge directly at the next court appearance to be assigned new counsel due to lack of communication. Courts do not grant these requests automatically, but documented attempts to reach an attorney that have gone unanswered are exactly the kind of circumstances judges consider when evaluating such requests.

Keep a written record. Document every call, message, and attempt to reach the attorney with dates and times. That record is essential if you need to escalate to a supervisor, the bar, or the judge.
