My son is in prison in Florida for being with under age girl. His classification officer recently told him that due to his charges he is not eligible for gain time.

Florida law specifically disqualifies certain categories of offenders from earning gain time, which is the credit that reduces the amount of a sentence that must be served. Sex offenses involving minors are among the most restricted categories in the Florida corrections system.

Under Florida statute, inmates convicted of certain sexual offenses, particularly those involving victims under the age of 18, are required to serve 100% of their imposed sentence with no reduction for gain time. This is not a classification officer's discretionary decision. It is written into Florida law as a mandatory sentencing requirement for those offense categories.

This means your son will serve the full length of whatever sentence was imposed by the judge. There is no good behavior credit, no program completion credit, and no early release mechanism available through gain time for these charges.

What remains available to him are programs and activities within the facility that, while they do not reduce his sentence, affect the quality of his time inside and his preparation for eventual release. Educational programs, vocational training, and therapeutic programming for sex offenders are available at most Florida facilities and are worth pursuing both for personal development and for satisfying any conditions tied to eventual supervised release.

Upon release, he will almost certainly be subject to sex offender registration requirements and supervision conditions. Understanding what those requirements look like in Florida and beginning to plan for compliance well before the release date is something worth addressing with his case manager as the sentence progresses.
