Will He Get Out After Missing His DV Review Date?

My boyfriend missed his domestic violence review hearing and is now back in county jail. He has a prior prison record. Will they let him out again?

There is no way to predict that with confidence without knowing more about the specifics, including whether new charges were filed, what the judge said at the last hearing, and what the terms of his supervision looked like. Those details matter a great deal in how the judge is going to read this.

What can be said is that missing a court-ordered DV review is a more serious misstep than missing a routine appearance. Domestic violence cases carry heightened scrutiny, and judges in DV matters are often less forgiving when someone fails to comply, particularly when there is a prior prison record in the picture. The fact that he was released the first time and still did not appear for the review makes the argument for release harder to make the second time around.

The outcome is going to come down to the judge, the circumstances behind the missed date, and what his attorney can put in front of the court. If there was a legitimate reason for not appearing, that needs to be documented and presented credibly. If there was not, his attorney's focus should be on damage control and demonstrating that he will comply going forward.

There is no way to know what mood the judge will be in or what weight they will give to each factor. The best thing to focus on right now is making sure he has solid legal representation for that hearing.
