How Do You Serve Divorce Papers to an Inmate in Prison?

My "husband" just pulled chains and was transported to Lexington Assessment and Reception in Lexington oklahoma on 09/09/2015. I'm tryin to serve him divorce papers. So how do I do this? I'm needing him to sign a waiver of summons and that requires a notary public is there one on staff at all prisons? How would I find out the proper guidelines to serving legal papers like tjis?

Serving legal papers to an inmate is a routine process and prisons are set up to handle it. Here is how it works.

Most correctional facilities have a notary public on staff. If your husband is willing to sign a waiver of summons, that waiver can be notarized right there at the facility. He would be called to the administrative offices by the unit secretary to accept service and sign any required documents. You do not need a court order or special permission to initiate this process.

To serve him formally, hire a licensed process server. Process servers handle inmate service regularly and know the protocol for working with facility staff. They will contact the facility in advance, coordinate with the unit secretary, and complete the service of process with the proper documentation your attorney will need.

A few practical steps to move this forward:

Contact the facility's administrative office at Lexington Assessment and Reception and let them know you intend to have legal papers served. Ask who the appropriate contact person is for coordinating service of process and what their preferred procedure is.

Make sure your attorney has the full facility address and your husband's inmate ID number so the process server can identify him correctly.

If your husband is cooperative and willing to sign the waiver, the process can move quickly. If he is not cooperative, formal service through a process server still accomplishes the legal requirement regardless of his willingness to engage.
