How Does an Inmate Get Their Belongings Back From an Ex?

My inmate is in Grand Forks Corrections. His ex charged him with assault. When he is released in Nov/14, How does he go about retrieving his personal belongings/household items from his apartment that his ex has now taken over?

The first thing to determine before any retrieval attempt is whether a restraining order or no-contact order exists as part of the assault case or as a condition of his parole or release. This is the most critical piece of information because approaching the apartment without knowing the answer could result in a new violation that sends him straight back inside regardless of his intention to simply collect his property.

If a restraining order is in effect, he cannot go to the apartment or make direct contact with his ex under any circumstances. The correct path in that situation is through his attorney, who can contact the court or the ex's legal representative to arrange a designated retrieval window where he is permitted to collect his belongings under controlled conditions. Law enforcement can sometimes be requested to stand by during that exchange to ensure it remains civil and documented.

If no restraining order exists and there are no contact restrictions attached to his release conditions, he has the legal right to retrieve his personal property. However, given the history between them and the assault charge that led to his incarceration, going alone is not advisable under any circumstances.
