The timeline for work release eligibility is not a universal number and it starts with the Judgment and Commitment order, which is the official court document that controls everything about how a sentence is served. Some sentences specifically authorize work release consideration while others exclude it entirely depending on the nature of the offense, the criminal history of the inmate, and the discretion exercised by the sentencing judge.

Assuming work release is not excluded by the court order, eligibility typically kicks in during the back end of a sentence when an inmate is approaching release and has demonstrated consistent good behavior throughout their time inside. Most facilities and state systems require inmates to have served a meaningful portion of their sentence before work release becomes an option.
