How Long Can Someone Be Detained for Illegal US Entry?

My husband was detained while trying to enter the US illegally. My question is how long do you believe he will be in there? Do you believe that the court will take into consideration of the fact that he has a family to maintain financially in the US? What should I expect or brace myself for?

Immigration detention is one of the most difficult situations to predict with any confidence because the variables are numerous and the political climate surrounding enforcement shifts frequently. What we can do is walk through the factors that will most directly shape what happens next.

The initial appearance before an immigration magistrate is the critical first event. At that hearing, a bond determination will be made. If bond is set, that is an encouraging sign. It means the court does not view him as a flight risk or a public safety concern serious enough to warrant mandatory detention. Immigration bonds typically range from $1,500 to $10,000 or more depending on the circumstances, and they can be posted through an immigration bond specialist.

If no bond is set, it signals that something in his background or the circumstances of his entry has raised a flag that the court is not willing to overlook. This could be a prior removal order, a criminal history, or a pattern of reentry that a judge views as deliberate circumvention of a prior legal decision. Appearing before the same judge who issued a prior removal order is rarely favorable, and those hearings tend to take a more serious turn.

Having a family in the United States, particularly a spouse and dependents who rely on him financially, is a legitimate factor that an immigration attorney can present as part of a case for release or relief. It is not a guarantee, but it is relevant and worth documenting carefully. Evidence of financial support, school enrollment for children, and community ties all strengthen that argument.
