Subject: Sentencing questions
The shorter release date is exactly what is supposed to happen, and it is good news rather than a mistake. When a sentence is imposed and the inmate enters the system, good time credits are applied at the start of the sentence rather than earned gradually over time. In California, most inmates receive a standard credit of half time, meaning they serve approximately 50 percent of the imposed sentence for most offenses, though some charges carry different percentages. On a three...

Subject: Inmate phone calls
Depends on where your inmate is incarcerated. In federal the phones turn on at 6am and off at 9:30. In county, they are available as long as the inmate is not locked in their cell which are normal waking hours. In state, it's almost unlimited as there are phones available in most cells.

The InmateAid phone line is matched to the lowest tariff at the facility your inmate is housed. You still fund the account as there is only one carrier. A call from your inmate may now cost $6.00 per 15-minutes, if there is a lower rate, we get you a number that will get it. If there are no savings, we do not issue a number. For the tens of thousands that do use it every month, the IA fee is covered...

Subject: Inmate phone calls
(we answered you directly earlier today via email.) this isn't a gimmick, it's just smart. we aren't replacing the phone carrier or suggesting we do. The InmateAid phone line is matched to the lowest tariff where your inmate is incarcerated. You still fund the account as there is only one way to get calls, and it's through a monopoly carrier that set the rates without a competitor. For instance, a call from your inmate may now cost $6.00 per 15-minutes, if there is a...

Subject: Parole, probation & supervised release
Most likely it's a mix of both. The program will probably be in some reentry facility that will alternately offer the drug counseling but also job placement - where she works on the street but sleeps there at night... for a transition period leading to getting all the way home (remember there is a range of possibilities we are just speculating...). You may obtain all of that information as it will be on the Parole Report as approved by the Board.

On bond, the odds are low and that is the standard position rather than an exception. When a judge revokes probation and issues a warrant, they are signaling that they do not trust the person to appear voluntarily. Bond exists to ensure appearance at future hearings, and a revocation warrant is already a finding that the conditions of supervision were not met. Most judges hold probation violators without bond until the revocation hearing precisely because the violation itself demonstrates the...

You cannot send a cross necklace - but an inmate is allowed to have it. What you might be able to do is speak with a counselor or case manager and tell them your desire. They might make arrangements for you to send it to them and then they would give it to the inmate, OR check to see if you can bring it to visitation. Also, InmateAid has a wide variety of Birthday Cards that are only $0.99 each.
Subject: Law & court questions - legal terms
Indictments have nothing to do with sentencing issues or guidelines. They are a formal naming of a person to a particular crime. It's common for charges to result in an indictment that long after arrest. You're innocent until proven guilty in a court of law, so no, an indictment by itself doesn't mean automatic jail time. To obtain an indictment against a suspected criminal, the prosecutor must present their case to a grand jury. A grand jury is a jury made of a group of 16-40 local citizens...

Subject: Law & court questions - legal terms
A pretrial hearing is a meeting that occurs before a trial action begins, attended by the plaintiff, the defendant, the judge, the lawyers, and maybe other involved parties. Pretrial hearings aim to resolve some of the legal issues before the trial begins where the judge is informed of such things as whether the parties are ready for trial, have all of their witnesses lined up, motions that may still be pending and the status of negotiations if any. The judge will usually issue an immediate response to any issues raised during a pretrial conference. The judge...
